Overview

One aspect of the comprehensive 2019 revision of the Act on Pharmaceuticals and Medical Devices ("PMD Act") is to step up enforcement regarding pharma advertising. Since 1 August 2021, an administrative penalty is charged amounting to 4.5 % of the profits made from (quasi-)pharmaceuticals or medical devices that were marketed using false or misleading advertising.

This new regime will significantly increase the risk of sanctions compared to similar rules under German law, which makes it vital for pharmaceutical companies active in the Japanese market to be aware of the diverging risk profile.

About the Event

Mr. Habe, quality assurance manager at B. Braun Aesculap Japan Co., Ltd. will share challenges and measures taken in response to the PMD Act from a business perspective.

Following Mr. Habe’s practical insights, the keynote speech by Japanese attorney Mr. Shingo Noguchi, specialized in healthcare and regulatory issues at TMI Associates, and Dr. Carmen Appenzeller, German attorney at ARQIS Foreign Law Office, will outline the new legal requirements and give plenty of real-life examples of the "dos and don’ts" in pharma advertising.
